Thread: Disabled Man Awarded $8K For Being Stuck on 'It's a Small World'

    A disabled man was awarded$8,000 in damages from Disneyland after he became trapped on the "It's a Small World" ride for thirty minutes in 2009.

    Jose Martinez was stuck in the "Goodbye Room" on the ride after it broke down on the 27th November 2009. Other passengers were evacuated, but Martinez was left to wait for half an hour while the “It’s a Small World” song repeated on a loop because he was in a wheelchair.

    “He was half in the cave of the ride and half out,” his attorney David Geffen. “The music was blaring. They couldn’t get it to go off.”

    Geffen says Martinez who suffered a spinal cord injury at age 16, also has chronic problems with diabetes, hypertension, panic attacks and anxiety disorder, according to court documents.

    Martinez, Rather than calling firefighters to get Martinez off the ride, staff just waited until the ride was fixed. After he that he was finally taken to the Disneyland first aid station, it took three hours to medically stabilize him.

    Geffen says half the award ordered Friday is for pain and suffering, and the rest is for a violation of disability law.

    Disneyland spokeswoman Suzi Brown said the Anaheim theme park believes it provided appropriate assistance during the incident, and is disappointed that the court did not fully agree. She also said that the violations have now been addressed.

    Wow. Someone really dropped the ball there. Music not withstanding, not having a way to bring him off the boat is a serious matter. What if there had been a fire? (My Mama's famous "always" question).

    He deserves compensation, and I'm not one to usually agree to that sort of thing, but this was a major error. Disney needs an OSHA and ADA violation fine for this one too. We need to keep our best companies, just that. The best.
